1. Acceptance of Terms

By downloading, installing, or using Kaka Camera (hereinafter referred to as "the App", "we", "us", or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you and Kaka Camera. If you do not agree to these Terms, you must not use the App.

You must be at least 13 years old (or the minimum age in your jurisdiction) to use this App.

2. Service Description

Kaka Camera is an AI-powered creative image generation platform that provides the following services:

AI Image Generation: Create images using text prompts and reference images through advanced AI models (Gemini).
Prompt Templates: Use, create, and share reusable prompt templates for consistent image generation.
Quality Levels: Choose between Draft (fast), Standard, and HD quality for different needs and budgets.
Creator Marketplace: Publish your templates and earn copyright fees when others use them.
Points System: Purchase points via in-app purchases to use our AI generation services.

3. User Accounts

Account Registration

You must provide accurate and complete information during registration. Your username must not impersonate others or violate third-party rights.

Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access.

One Account Per User

Each user may only maintain one active account. Creating multiple accounts to abuse the system is prohibited.

Account Responsibility

You are responsible for all activities that occur under your account, whether or not authorized by you.

4. Points, Payments & Refunds

Points System

- Points are a virtual currency used to access AI generation services
- Points have no cash value and cannot be exchanged for real currency
- Points are non-transferable between accounts
- Unused points do not expire as long as your account remains active

Pricing & Costs

- Base Cost: Each AI generation task has a base cost determined by quality level
- Quality Multipliers: Draft (0.2x), Standard (1.0x), HD (2.0x)
- Copyright Fees: Using third-party templates may incur additional copyright fees set by the template author
- Prices may change with notice; existing points will honor their original value

In-App Purchases

- All purchases are processed through Apple App Store (iOS)
- Prices are displayed in your local currency
- Purchases are charged to your Apple ID account
- Points are credited immediately upon successful payment verification

Refund Policy

- Refund requests must be made through Apple's standard refund process
- If a refund is granted, corresponding points will be deducted from your account
- Refunds for used points may not be available
- We reserve the right to suspend accounts that abuse refund policies

5. Content & Intellectual Property

Your Generated Content

- You retain ownership of the images you generate using our AI services
- You may use generated images for personal and commercial purposes
- You grant us a license to display, process, and store your generated content to provide our services
- AI-generated content may have limitations on copyright protection in some jurisdictions

Prompt Templates You Create

- You retain copyright to original prompt templates you create
- By publishing a template as "public", you grant other users a license to use it
- You may set a copyright fee for your templates; users will pay this fee to use them
- Revenue is held for 30 days before settlement (to accommodate refunds)
- You warrant that your templates do not infringe third-party rights

Using Others' Templates

- Copyright fees paid for template usage are non-refundable once the task is processed
- You receive a license to use the template for image generation only
- You may not redistribute, resell, or claim ownership of others' templates

Our Intellectual Property

- The App, its design, code, and features are our intellectual property
- "Kaka Camera" name, logo, and branding are our trademarks
- You may not copy, modify, or reverse-engineer the App

6. Prohibited Uses

You agree NOT to use the App to:

Generate illegal, harmful, or objectionable content (violence, hate speech, explicit content involving minors)
Create deepfakes or misleading content intended to deceive or defraud
Infringe on intellectual property rights of third parties (trademarks, copyrights)
Generate images of real people without their consent (including celebrities)
Attempt to bypass content moderation or safety filters
Abuse, exploit, or circumvent the points system or pricing
Use automated bots or scripts to access the service
Interfere with or disrupt the App's servers or networks

Violation of these rules may result in immediate account termination without refund.

7. AI-Generated Content Disclaimer

Please understand the nature of AI-generated content:

AI results may be unpredictable and may not always match your expectations
Generated images may occasionally contain artifacts, errors, or unintended elements
We cannot guarantee specific results or outcomes
AI models are provided by third parties and are subject to their limitations
Generated content may inadvertently resemble existing copyrighted works

8. Service Availability & Modifications

Service Availability

We strive for high availability but do not guarantee uninterrupted service. Maintenance, updates, and technical issues may cause temporary unavailability.

Modifications

We reserve the right to modify, suspend, or discontinue any feature of the App at any time. Significant changes will be communicated through the App.

Third-Party Dependencies

Our service depends on third-party AI providers. Changes to their services may affect our features and capabilities.

9. Account Termination

Termination by You

You may delete your account at any time through the App settings. Unused points will be forfeited upon account deletion.

Termination by Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse our services. We may provide notice when feasible.

Effect of Termination

Upon termination, your right to use the App ceases. Your content may be deleted, though some data may be retained as required by law.

10. Disclaimer & Limitation of Liability

Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kaka Camera, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) content you create or share through the App.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

You agree to attempt to resolve any dispute informally by contacting us first before initiating formal proceedings.

13. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through the App or by other means. Your continued use of the App after such changes constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the App.
