Kaka Camera - AI-Powered Creative Image Generation

Effective Date: December 15, 2025

IMPORTANT - PLEASE READ CAREFULLY

This End User License Agreement ("EULA") is a legal agreement between you and Kaka Camera. By installing, copying, or otherwise using the Application, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Application.

1. License Grant

Subject to the terms of this EULA, Kaka Camera grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Application on devices you own or control
  • Use the Application for personal and commercial creative purposes
  • Create, store, and share content generated through the Application
  • Publish and monetize prompt templates you create

2. License Restrictions

You may NOT:

  • Copy, modify, or distribute the Application
  • Reverse engineer, decompile, or disassemble the Application
  • Rent, lease, lend, sell, or sublicense the Application
  • Remove any proprietary notices or labels on the Application
  • Use the Application for any illegal purpose
  • Transfer your license or account to another party
  • Use automated systems to access or interact with the Application

3. User Content & Intellectual Property Rights

3.1 AI-Generated Images

  • Ownership: You retain ownership rights to images generated through your use of the Application, subject to the terms below.
  • Usage Rights: You may use AI-generated images for personal projects, commercial work, social media, merchandise, and other purposes.
  • License to Us: You grant Kaka Camera a worldwide, royalty-free license to store, process, display, and transmit your generated content solely to provide and improve our services.
  • AI Limitations: Note that copyright protection for AI-generated content may be limited or unavailable in certain jurisdictions.

3.2 Prompt Templates You Create

  • Authorship: You retain authorship and intellectual property rights to original prompt templates you create.
  • Public Templates: When you publish a template as "public", you grant other users a non-exclusive license to use that template for AI image generation.
  • Copyright Fees: You may set copyright fees for your public templates. Users must pay this fee to use your template.
  • Revenue Share: You receive the copyright fees paid by users, subject to our revenue distribution schedule (30-day hold period).
  • No Infringement Warranty: You warrant that your templates do not infringe any third-party intellectual property rights.

3.3 Using Others' Templates

  • License Scope: When you use another user's template, you receive a license to use that template for generating images only.
  • No Redistribution: You may not copy, modify, redistribute, or claim ownership of others' prompt templates.
  • Output Rights: Images you generate using others' templates belong to you, subject to Section 3.1.
  • Fee Non-Refundable: Copyright fees are non-refundable once the generation task has been processed.

3.4 Uploaded Reference Images

  • Your Responsibility: You are solely responsible for ensuring you have the right to upload and use reference images.
  • No Infringement: You must not upload images that infringe copyrights, trademarks, or other intellectual property rights.
  • Processing License: By uploading images, you grant us the right to process them through AI services to fulfill your generation requests.
  • Retention: Uploaded images are stored for your convenience and may be deleted upon your request or account termination.

4. Content Guidelines & Acceptable Use

You agree to follow these content guidelines when using the Application:

Permitted Content

  • - Original creative artwork
  • - Fictional characters
  • - Landscapes and abstract art
  • - Product designs and mockups
  • - Marketing and advertising materials
  • - Educational illustrations

Prohibited Content

  • - Child sexual abuse material (CSAM)
  • - Non-consensual intimate images
  • - Hate speech or discrimination
  • - Violence promoting terrorism
  • - Realistic images of real people without consent
  • - Content that violates applicable laws

Brand Content Notice: Templates containing brand names, logos, or celebrity likenesses may be flagged or restricted. Such content may violate trademark rights and publicity rights.

5. Virtual Currency (Points)

5.1 Nature of Points

Points are a limited license to access certain features of the Application. They are NOT:

  • - Real currency or money
  • - Property that can be owned
  • - Exchangeable for cash or any other value
  • - Transferable between accounts

5.2 Purchase and Use

Points can be purchased through in-app purchases. All purchases are final. Points are consumed when you initiate AI generation tasks.

5.3 Forfeiture

Points may be forfeited if your account is terminated for violation of this EULA. No refund will be provided for forfeited points.

6. Third-Party Services

The Application integrates with the following third-party services:

Google Gemini AI

Powers our image generation. Subject to Google's Terms of Service and AI Acceptable Use Policy.

Apple App Store

Handles in-app purchases. Subject to Apple's Terms and Conditions.

AWS (Amazon Web Services)

Provides cloud storage for images. Subject to AWS Service Terms.

We are not responsible for the performance, availability, or content policies of third-party services.

7. Privacy & Data

Your use of the Application is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

By accepting this EULA, you also acknowledge that you have read and agree to our Privacy Policy.

8. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KAKAAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kaka Camera and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

  • Your violation of this EULA
  • Your use of the Application
  • Content you create, upload, or share through the Application
  • Your violation of any rights of another party

11. Termination

11.1 Termination by You

You may terminate this license by deleting the Application and your account. Deletion is permanent and cannot be undone.

11.2 Termination by Us

We may terminate or suspend your license immediately, without prior notice, if you breach any provision of this EULA.

11.3 Effect of Termination

Upon termination: (a) your license rights end; (b) you must cease all use of the Application; (c) we may delete your content and data; (d) provisions that should survive termination will remain in effect.

12. Governing Law

This EULA shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from this EULA shall be resolved through binding arbitration or in courts of competent jurisdiction.

13. Changes to This EULA

We reserve the right to modify this EULA at any time. We will notify you of material changes through the Application or by other means. Your continued use of the Application after such modifications constitutes acceptance of the updated EULA.

14. Entire Agreement

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Kaka Camera regarding the Application and supersedes all prior agreements and understandings.
